GeoLawWatch Bill Summary

This resolution does not set public rules or penalties. As a House Resolution rather than a bill, HR 35 states legislative intent and policy but lacks the force of law.

The resolution includes the following points:

  • Declares prohibition: States that "no person shall engage in geoengineering, including weather modification, stratospheric aerosol injection, or solar radiation modification by intentionally releasing polluting emissions in New Hampshire."
  • Sets a notification requirement: The Commissioner of the Department of Environmental Services must, within 30 days of adoption, notify 27 federal agencies (including NOAA, NASA, EPA, DOD, FAA, and others) about this policy. The Commissioner must also create a webpage with the resolution text and copies of the certified letters sent to these agencies.
  • Invokes state sovereignty: Cites Tenth Amendment authority for state action when federal programs or restrictions become oppressive or destructive.

Important limitation: Unlike laws, which create binding legal obligations and can be enforced, resolutions only express the legislature’s views and do not create legal rules or enforcement mechanisms. This resolution imposes no penalties, compliance requirements, permit restrictions, or enforcement steps besides notification to the Department of Environmental Services.

History

HR 35 was introduced for the 2026 regular session and is scheduled for introduction on January 7, 2026, with assignment to the House Science, Technology and Energy Committee. The resolution carries eight sponsors, led by Rep. Potenza (Strafford County District 19), with co-sponsors from Rockingham, Hillsborough, Merrimack, Sullivan, and Grafton counties.

The 2026 New Hampshire session began January 7 and runs through June 30, 2026, according to legislative session calendars. New Hampshire operates under carryover provisions, meaning bills from 2025 can carry over into 2026, though this is a newly introduced 2026 measure. The state allowed prefiling beginning September 15, 2025, though this resolution appears to have been filed during the regular introduction period.

As a resolution rather than a bill, HR 35 follows a different legislative path than statutory measures. House Resolutions require passage only by the House of Representatives (not the Senate) and are not submitted to the Governor for signature. They serve to express the House's formal position on matters of policy or procedure. The assignment to the Science, Technology and Energy Committee suggests the measure will receive substantive review despite its non-statutory nature. However, committee action on resolutions varies from that on bills.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty-Six

A RESOLUTION urging the prohibition of the intentional release of polluting emissions, including cloud seeding and weather modification, to preserve the atmosphere of New Hampshire.

Whereas, many atmospheric activities such as weather modification, stratospheric aerosol injection (SAI), solar radiation modification (SRM), and other forms of geoengineering, involving the intentional release of polluting emissions, harm human health and safety, the environment, agriculture, wildlife, aviation, state security, and the economy of the state of New Hampshire; and

Whereas, it is the intention of the New Hampshire house of representatives to prohibit the intentional injection, release, or dispersion, by any means, of chemicals, chemical compounds, substances, or apparatus within the borders of this state into the atmosphere with the express purpose of affecting temperature, weather, or the intensity of the sunlight, thereby prohibiting geoengineering (including SAI and SRM) and other intentionally polluting activities in New Hampshire’s atmosphere and/or at ground level to preserve the safe, healthful, and peaceful uses of New Hampshire’s atmosphere for people, wildlife, and agriculture; and

Whereas, due to necessity arising from the federal stance and the potential and ease for enemies, foreign and domestic, to cause harm intentionally, the states’ rights, including their authorities, are correctly exerted pursuant to the Tenth Amendment, where federal programs and restrictions have become oppressive or destructive; now, therefore, be it

Resolved by the House of Representatives: the house hereby declares that no person shall engage in geoengineering activities, including weather modification, stratospheric aerosol injection, or solar radiation modification involving the intentional release of polluting emissions within the borders of the state of New Hampshire.

Let it be further resolved that the commissioner of the department of environmental services shall, within 30 days of the adoption of this resolution, provide notice of this policy to the following entities and shall also create a dedicated page on the department of environmental services' website containing a copy of this resolution and copies of each certified letter sent to the following entities:
